These Terms of Use ("Terms") govern your access to and use of the Vinault Club mobile application ("App"), operated by its developer ("Developer"). By using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.
This application is intended solely for personal inventory tracking. It does not constitute a commercial service for the purchase, sale, or distribution of alcoholic beverages. Any use of the App for commercial purposes without prior written authorization from the Developer is strictly prohibited.
All information entered into the App (prices, vintages, ratings, quantities) is the sole responsibility of the user. The Developer does not guarantee the accuracy, completeness, or timeliness of any data entered or displayed within the App.
Prices estimated by artificial intelligence are indicative only and do not constitute a commercial offer, investment advice, or guarantee of market value. The Developer expressly disclaims any liability arising from decisions made based on AI-generated price estimates.
Vinault Club does not encourage excessive alcohol consumption. Alcohol should be consumed in moderation and in accordance with local laws. The sale and consumption of alcohol by minors is strictly prohibited.
Data is stored locally on the device. The Developer is not liable for data loss resulting from app deletion, device change, factory reset, or any technical failure of the device or operating system.
The Developer is not responsible for any purchase, sale, or consumption decisions made based on information displayed by the App. To the maximum extent permitted by applicable law, the Developer's total liability for any claim arising out of or related to the App shall not exceed the amount paid by the user for the App in the twelve (12) months preceding the claim.
Vinault Club is provided on an "as is" and "as available" basis. The Developer does not warrant that the App will be uninterrupted, error-free, or continuously available. The App may be temporarily unavailable due to scheduled maintenance, technical failures, software updates, or circumstances beyond the Developer's control, including but not limited to internet outages, device incompatibilities, or operating system changes. The Developer shall not be held liable for any loss, inconvenience, or damage of any kind resulting from service interruptions, app crashes, unexpected downtime, or any other technical issue affecting the availability or performance of the App.
Vinault Club may display information about or provide access to third-party wine merchants, suppliers, or retailers. Any transaction or purchase made through or in connection with a third-party supplier is entered into exclusively between the user and that supplier. The Developer assumes no responsibility whatsoever for product quality, authenticity, delivery, pricing accuracy, stock availability, customs clearance, or any other issue arising from such purchases. All claims, disputes, complaints, or demands related to purchases made with third-party suppliers must be directed exclusively to the respective supplier or merchant. The Developer's liability is expressly excluded in connection with any such transaction.
Although Vinault Club is currently offered free of charge, the Developer expressly reserves the exclusive right to evaluate, approve, or deny any refund request in the event that paid features, subscriptions, or in-app purchases are introduced at any time in the future. All refund decisions are made solely at the Developer's discretion, in compliance with applicable laws and the policies of the relevant app store platform. Refund requests are not subject to appeal and must be submitted through the official support channel provided within the App or through the applicable app store. The existence of a refund request does not guarantee its approval.
These Terms are effective as of the date you first accept them. The Developer reserves the right to update or modify these Terms at any time. Users will be notified of material changes through an in-app notice or prompt requiring renewed acceptance before continued use of the App. Continued use of the App after changes are made constitutes acceptance of the revised Terms.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify the Developer immediately of any unauthorized use of your account. The Developer reserves the right to suspend or permanently terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other users or the integrity of the App, with or without prior notice.
You agree not to: (a) copy, modify, distribute, or create derivative works of the App; (b) reverse engineer, decompile, or disassemble any part of the App; (c) use the App for any unlawful purpose or in violation of any applicable regulation; (d) attempt to gain unauthorized access to any part of the App or its related systems; (e) use automated tools, bots, or scripts to interact with the App; or (f) resell, sublicense, or commercially exploit the App or its content without prior written consent from the Developer.
All content within the App, including but not limited to its design, layout, graphics, interface, trademarks, and underlying code, is the exclusive property of the Developer and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the App or its content beyond the limited license to use the App for personal purposes as described herein.
The Developer is committed to protecting your personal data in accordance with applicable privacy laws, including the Brazilian General Data Protection Law (Lei Geral de Proteção de Dados — LGPD, Law No. 13,709/2018) and, where applicable, the General Data Protection Regulation (GDPR). Data collected through the App is used solely to provide and improve the App's features. The Developer does not sell personal data to third parties. Any content you create, upload, or store within the App — including wine photos, notes, ratings, and inventory records — remains your property. By using the App, you grant the Developer a limited, non-exclusive, royalty-free license to store and process such content solely for the purpose of providing the App's functionality. The Developer will not use your personal content for marketing, advertising, or any purpose beyond the operation of the App without your explicit consent.
The App involves the management of alcoholic beverages and is intended exclusively for adults of legal drinking age in their respective country of residence. By accepting these Terms, you confirm that you are of legal age to purchase and consume alcohol under the laws of your jurisdiction. The Developer does not knowingly permit use of the App by minors and reserves the right to terminate accounts found to belong to underage users.
These Terms shall be governed by and construed in accordance with the laws of Brazil. Any dispute arising out of or relating to these Terms or the use of the App that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of São Paulo, Brazil, unless otherwise required by mandatory consumer protection laws applicable in the user's country of residence.
